Everingham Lawyers is subject to the provisions of the Privacy Act 1998 (Ctn) (“Privacy Act”) and the National Privacy Principals (“NPP”) contained therein. We are required under this Act to disclose to you:

  • The reason for the collection of your information; and
  • Parties to whom we may disclose your information; and
  • How you can obtain information withheld about you.

In addition to the Privacy Act, we are also bound by our professional obligations which may impact on the manner in which we deal with personal information given to us by you.

We collect personal information from you in order to provide you with legal services and to meet our legal obligations.

The instructions you provide to us will impact on the personal information we are required to obtain in order to progress your matter.

Use and disclosure of your information

We may use and disclose your personal information for the reasons that we collect it. Unless we have first contained your consent, we will use and disclose your personal information for the following purposes:

  • To conduct our business; and
  • To comply with our legal obligations.

It may be necessary for us to disclose your personal information to:

  • Courts, Tribunals and other regulatory authorities;
  • Other Experts, Solicitors, Companies or individuals who assist us in representing you or who perform services on our behalf (for example Barristers).

If we marketed our products and services to you and you no longer wish to receive those of communications from us, you should conduct our Privacy Officer and we will ensure that this is corrected.

Any other use or disclosure we make will only be as required by law or permitted under the Privacy Act.

So that we may keep the personal information collected, used or disclosed by us accurate, complete and up to date, we encourage you to keep us informed of any changes to your personal information and update us from time to time

Access to your personal information

You may have access to your personal information which we hold about you (subject of course to the exemptions provided under the Privacy Act) upon written request.
